Terms & Conditions

These Terms and Conditions ("Terms") govern your use of Mendways services and our website at mendwaysayyes.pro. By booking a session or using our website, you agree to these Terms. Please read them carefully.

1. Definitions

• "Mendways", "we", "us", "our" — refers to the facilitation studio operating from Suite 8-2, Jalan Tun Abdul Razak, 80000 Johor Bahru, Johor, Malaysia.
• "Services" — the facilitation sessions, programmes, and related documentation described on our website.
• "User", "you" — any person who contacts us, uses our website, or participates in a facilitation session.
• "Session" — any individual facilitated conversation held under a Single Session, Three-Session Block, or Long-Form Programme arrangement.
• "Agreement" — the engagement agreed between Mendways and the person requesting facilitation, confirmed following the intake call.

2. Acceptance of Terms

By submitting an enquiry, participating in an intake call, or engaging our Services, you confirm that:

• You are at least 18 years of age, or a guardian acting on behalf of a minor participant where applicable
• You have the capacity to enter into this Agreement
• You agree to these Terms on behalf of yourself and, where relevant, the other participants you are arranging facilitation for

3. Description of Services

Mendways provides structured conversation facilitation for families. Our services are facilitative in nature and do not include:

• Legal advice or representation
• Psychological assessment or treatment
• Counselling or therapeutic intervention
• Mediation in the legal or formal dispute-resolution sense

Services are provided in English and are available in person at our Johor Bahru studio. Availability is subject to facilitator scheduling and confirmation following the intake call.

4. Booking and Confirmation

All session bookings require:

• Completion of an intake call with a Mendways facilitator
• Agreement on session format, date, time, and participants
• Payment of the applicable fee (or a deposit where indicated) before the session is confirmed

A session is not confirmed until you have received written confirmation from Mendways.

5. User Responsibilities

Participants in facilitation sessions agree to:

• Engage in good faith with the facilitation process
• Treat other participants and the facilitator with respect
• Arrive on time and prepared for sessions
• Maintain the confidentiality of what other participants share in sessions
• Not record sessions without the written consent of all participants and Mendways

Mendways reserves the right to end a session if participant conduct makes continuation unsafe or unproductive. In such cases, the session fee is not refundable.

6. Fees and Payment

Current session fees are:

• Single Conversation Facilitation: RM 720
• Three-Session Facilitation Block: RM 1,940
• Long-Form Facilitation Programme: RM 3,040

All fees are in Malaysian Ringgit (RM) and include GST where applicable. Payment methods and timing are confirmed during the intake process. Mendways reserves the right to adjust fees; any change will be communicated before it applies to your engagement.

7. Cancellation and Rescheduling

• More than 48 hours before a session: You may reschedule at no charge, subject to facilitator availability.
• 24–48 hours before a session: A rescheduling fee of 20% of the session fee applies.
• Less than 24 hours before a session: The session fee is forfeited.
• Cancellation of a block or programme: Sessions completed are charged at the single-session rate; unused sessions are refunded less an administrative fee of RM 150.

Mendways reserves the right to cancel or reschedule sessions due to facilitator illness or other circumstances beyond our control. In such cases, a full rescheduling or refund will be offered.

8. Intellectual Property

All materials produced by Mendways, including the printed workbook provided in the Long-Form Programme, session summary templates, and website content, remain the intellectual property of Mendways. Participants may use these materials for personal reference only and may not reproduce or distribute them without written permission.

9. Confidentiality

Mendways treats the content of all facilitation sessions as confidential. Session content will not be disclosed to parties outside the participating family except where required by Malaysian law or a court of competent jurisdiction. Participants are also expected to maintain confidentiality regarding what other participants share during sessions.

10. Disclaimers

Mendways provides facilitation services as described. We do not warrant any particular outcome from facilitation. Results depend on the willingness and engagement of participants. Mendways does not provide legal, financial, medical, or therapeutic advice of any kind.

11. Limitation of Liability

To the fullest extent permitted by Malaysian law, Mendways shall not be liable for indirect, incidental, or consequential damages arising from your use of our services or website. Our total liability in connection with any engagement shall not exceed the fees paid for that engagement.

12. Indemnification

You agree to indemnify Mendways against any claims, losses, or expenses arising from your breach of these Terms or your conduct during facilitation sessions.

13. Termination

Either party may terminate an ongoing engagement with written notice. Where Mendways terminates an engagement for reasons other than participant misconduct, fees for sessions not yet held will be refunded in full. Where a participant terminates, the cancellation policy in Section 7 applies.

14. Governing Law

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or your use of our services shall be subject to the jurisdiction of the courts of Johor, Malaysia. We encourage informal resolution of disputes before any formal proceedings and welcome direct communication in the first instance.

15. General Provisions

• Entire agreement: These Terms, together with any written engagement confirmation, constitute the entire agreement between you and Mendways in relation to the services.
• Severability: If any provision of these Terms is found unenforceable, the remainder continues in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in future.

16. Changes to These Terms

We may update these Terms from time to time. The current version is always published on this page with a revised "Last Updated" date. Continued use of our services after an update constitutes acceptance of the revised Terms.
